Third Party Billing
AAM may share data with trusted partners to help perform statistical analysis, send email, or provide customer support. All such third parties are prohibited from using Participant’s personal information except to provide these services to AAM and they are required to maintain the confidentiality of Participant information. AAM does not sell, rent or lease customer lists to third parties.
AAM will use commercially judicious efforts to restrict unauthorized access to Participant’s files and data. Nevertheless, not even password protected systems are completely impassable. Participant acknowledges it may be possible for an unauthorized third party to view, copy, access or distribute files and data that the Participant stores on the Site. Use of the AAM Site is completely at Participant’s own risk.
Under no circumstances will AAM, nor any other party involved in creating or maintaining the Site and its content, be liable for any direct, indirect, consequential or punitive damages arising out of Participant’s use of the Site. All content on the Site is provided “as-is” without expressed or implied warranty.
AAM may use a third-party credit card merchant to take payment from the Participant. This third party will check and process Participant payment details. There are strict obligations that govern credit card merchants' handling of personal data. However, AAM cannot be held responsible for actions by this third party. AAM accepts no liability for loss and/or damage that Participant may suffer as a result of this third party's acts and/or omissions. AAM advises Participant to print and retain a copy of each card transaction for future reference.
Collection of your Personal Information
AAM may collect personally identifiable information, such as Participant’s Name, Address, E-mail Address and Phone Number.
When Participant purchases Event Tickets, AAM collects billing and credit card information, billing and shipping address, telephone number and other information necessary to complete the transaction. This information is used to complete the purchase transaction. AAM requests and requires personal data to better understand Participant’s needs and provide improved service.
AAM may also use Participant’s personally identifiable information to inform Participant of other products or services available from our affiliates.
The AAM website may use "cookies" to help Participant personalize their online experience. A cookie is a text file that is placed on Participant’s hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to a computer. Cookies are uniquely assigned to each participant and can only be read by a web server in the domain that issued the cookie.
Illegal or prohibited use of our Intellectual Property
Participant agrees that no joint venture, partnership, employment, or agency relationship exists between Participant and AAM as a result of this agreement or use of the Site.
All content and any software used on the Site, is the property of AAM and/or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. Participant agrees to observe and abide by all copyright and other proprietary notices and agree to not make any changes therein.
Participant will not copy, reproduce, modify, publish, republish, transmit, upload, post, distribute, download, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content found on the Site. Participant agrees to use AAM content solely for personal use and will make no other use of the content without the express written permission of AAM.
Participant may not assign or otherwise transfer your customer account to any other person or entity. Participant acknowledges that AAM is not responsible for third party access to customer accounts that results from theft or misappropriation of accounts.
AAM and our associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content at AAM’s sole discretion.
Providing Materials to AAM.
By Providing Materials to AAM, including but not limited to feedback, suggestions, posts, comments, and/or submissions. Participant is granting AAM and AAM affiliates permission to use Participant’s Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, reproduce, edit, translate and reformat Submission; and to publish Participant’s name in connection with the Submission.
No compensation will be paid with respect to the use of Participant’s Submission, as provided herein. AAM is under no obligation to post or use any Submission Participant may provide and may remove any Submission at any time at AAM’s sole discretion.
AAM Live PMU Summit
TERMS & CONDITIONS
Please read these Terms & Conditions carefully before purchasing tickets to the AAM Live PMU Summit (“Event”).
Event Programs, Products, and Services are owned and operated by American Academy of Micropigmentation (“AAM”, “Company”, “we”, or “us”). The term “Participant” refers to any purchaser and/or user of any of our Programs, Products and/or Services including, but not limited to, AAM Live PMU Summit Event tickets.
Intellectual Property Rights
AAM Programs, Products, and Services and all the Program Materials are the property of the AAM and/or affiliates or licensors, and are protected by copyright, trademark, and other intellectual property laws.
When Participant purchases tickets to the Event, Participant agrees that Participant is clearly and expressly prohibited from doing the following:
- Participant will not in any way use, copy, adapt or represent any of AAM Programs or Materials in any way as if they are owned or created by the Participant.
- Participant will not engage in improper and/or unauthorized use of AAM Programs or Materials. Improper and unauthorized use includes, but is not limited to, modifying, copying, reproducing, republishing, uploading, posting, transmitting, translating, selling, creating derivative works, exploiting, or distributing in any manner or medium (including by email or other electronic means) any Program Materials or any other information accessed or purchased at the Event in any way that earns you money.
- Any trademarks, taglines, and logos displayed on Program Materials are trademarks belonging to AAM. Any use including framing, meta tags or other text utilizing these trademarks, or other trademarks displayed, is strictly prohibited without express written consent, or permission from AAM in writing granted herein.
For those trademarks, taglines, and logos for which Participant is granted permission to use, the trademark indicia must be included at all times. Any marketing or promotional tools and/or Program, Product or Service titles or any other title or information of AAM and/or affiliates bearing the trademark symbols (™) or ® may not be used by Participant for any reason without express written permission.
Medical Disclaimer. AAM Programs, Products, Services, and Program Materials are not to be perceived as or relied upon in any way as medical advice or mental health advice. The information provided through Event Programs, Products, Services, and Program Materials is not intended to be a substitute for professional medical advice, diagnosis or treatment that can be provided by Participant’s own physician, nurse practitioner, physician assistant, therapist, counselor, mental health practitioner, licensed dietitian or nutritionist, member of the clergy, or any other licensed or registered health care professional. Do not disregard professional medical advice or delay seeking professional advice because of information read in AAM Programs, Products, Services, and Program Materials, or received from us. Do not stop taking any medications without speaking to a qualified physician, nurse practitioner, physician assistant, mental health provider or other health care professional. If Participant has or is suspected to have a medical or mental health issue, contact a qualified health care provider promptly. AAM is not providing health care, medical or nutrition therapy services or attempting to diagnose, treat, prevent or cure in any manner whatsoever any physical ailment, or any mental or emotional issue, disease or condition. AAM is not giving medical, psychological, or religious advice whatsoever.
Legal and Financial Disclaimer. AAM Programs, Products, Services, and Program Materials are not to be perceived or relied upon in any way as business, financial or legal advice. The information provided through AAM Programs, Products, Services, and Program Materials is not intended to be a substitute for professional advice that can be provided by the Participant’s own accountant, lawyer, or financial advisor. AAM is not giving financial or legal advice in any way. Participants are hereby advised to consult with their own accountant, lawyer or financial advisor for any and all questions and concerns regarding Participant’s own income and taxes pertaining to Participant’s specific financial and/or legal situation. Participant agrees that AAM is not responsible for Participant’s earnings, the success or failure of Participant’s business decisions, the increase or decrease of Participant’s finances or income level, or any other result of any kind that Participant may have as a result of information presented to through AAM Programs, Products, Services, and Program Materials. Participants are solely responsible for their own results.
Earnings Disclaimer. Participant acknowledges that AAM has not and does not make any representations as to the health physical, mental, emotional, spiritual or health benefits, future income, expenses, sales volume or potential profitability or loss of any kind that may be derived as a result of participation in this Program, Product, Services or Program Materials. AAM cannot and does not guarantee that Participant will attain a particular result, positive or negative, financial or otherwise, through the use of AAM Programs, Products, Services and Program Materials and Participant accepts and understands that results differ for each individual. AAM also expressly disclaims responsibility in any way for the choices, actions, results, use, misuse or non-use of the information provided or obtained through any of the AAM Programs, Products, Services or Program Materials. Participant agrees that Participant results are strictly their own and AAM is not liable or responsible in any way for Participant results.
Participant understands that at this Event or related activities, Participant may be photographed. Participant agrees to allow the photo, video, or film likeness, voice, or persona to be used for any legitimate purpose, including commercial purposes, by any of the Released Parties, without fee or royalty. The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
When Participant purchases a ticket to the Event, AAM may seek and collect personal data and information, including but not limited to Participant name, e-mail address, phone number, billing information, credit card or payment information, demographic information, preferences, interests, or other personally identifying information (“Confidential Information”).
By providing such Confidential Information to AAM, Participant grants AAM permission to use and store such Confidential Information. AAM, in turn, will make efforts to keep Participant Confidential Information safe, secure and confidential. AAM takes precautions to protect such Confidential Information. AAM take measures to protect the security of Participant Confidential Information both online and offline. However, due to the nature of the Internet, AAM cannot completely ensure or warrant the security of Participant Confidential Information or of any other data or information transmitted to AAM or through AAM services; therefore submitting Confidential Information, data or other information is done at Participant’s own risk.
Purchases and Online Commerce
If paying by PayPal, debit card, or credit card, Participant gives AAM permission to automatically charge your credit or debit card as payment for Event ticket without any additional authorization, for which Participant will receive an electronic receipt. Should Participant be provided with a PayPal invoice instead, Participant is required to manually pay it by the date due on the invoice or the Event Ticket will be put on hold for 7 days until payment is made, at which time Participant ticket request will be forfeited.
Order Prices, Availability, and Modifications
AAM reserves the right to cancel Participant’s order at any time for any reason including, but not limited to, shortages of materials, increases in price of materials, mistaken pricing on AAM website or marketing materials, or any other purpose that AAM may deem appropriate. Any changes to the Agreement will be effective immediately for new buyers, while any material changes will become effective after thirty (30) days for previous purchases. Participant’s continued use of AAM site and products constitutes Participant’s acceptance of such changes. Participant agrees that AAM may charge Participant the applicable price and shipping cost agreed to at the time of checkout, and that payment is not immediately refundable once order confirmation has been sent.
Because of the extensive time, effort, preparation and care that goes into creating this Event, AAM has a NO REFUND POLICY. Unless otherwise provided by law, Participant acknowledges that AAM does not offer refunds for any portion of Participant’s payment for Event tickets and no refunds will be provided to Participant at any time. By purchasing AAM Live PMU Summit Event tickets, Participant understands and agrees that all sales are final and no refunds will be provided.
Since AAM has a clear and explicit Refund Policy in these Terms & Conditions that Participant has agreed to prior to completing the purchase of Event tickets, AAM does not tolerate or accept any type of chargeback threat or actual chargeback from Participant’s credit card company. In the event that a chargeback is placed on a purchase, or AAM receives a chargeback threat during or after purchase, AAM reserves the right to report the incident to all three credit reporting agencies or to any other entity for inclusion in any chargeback database or for listing as a delinquent account which could have a negative impact on Participant’s credit report score. The information reported will include Participant’s name, email address, order date, order amount, and billing address. Chargeback abusers wishing to be removed from the database shall make the payment for the amount of the chargeback.
If for any reason Participant finds that they cannot attend the Event, Participant is permitted to transfer the Event ticket to another individual, based on the following criteria:
All substitution requests must be received in writing from the original registrant to: [email protected] and must have the new registrant copied on the email.
The new registrant information must be provided, and they will be required to sign and agree to AAM Terms & Conditions, Event Waiver and Media Release, as the original purchaser did when purchasing the Event Ticket.
Substitutions may be made until 15 days before the conference begins.
Differences in registration type or event selection may cause an increase in registration fees which will be the responsibility of the new registrant.
PARTICIPANT CERTIFIES THAT THEY HAVE READ THIS DOCUMENT AND FULLY UNDERSTANDS ITS CONTENT. PARTICIPANT IS AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND HEREBY SIGNS IT OF THEIR OWN FREE WILL.
